Terms of Service

These terms govern your use of The Sites (thesites.app), a website-building, hosting and business-messaging service operated by NovaDyne Sdn Bhd (“we”, “us”), a company incorporated in Malaysia. By creating an account or using the service you agree to these terms.

1. The service

The Sites lets you create websites (including with AI assistance), publish them on our infrastructure or your own domain, receive enquiries and booking requests, and receive related notifications and reports. Features vary by plan.

2. Your account

You must provide a valid email address and keep your password secure. You are responsible for activity under your account. One subscription covers one account; plans are described at thesites.app and can change with notice.

3. Fees and billing

Plans are billed in Malaysian Ringgit, monthly or yearly, in advance, via our payment provider (Airwallex). Prices are shown before checkout. If a subscription lapses, your published sites go offline after a grace period, and account data is deleted after approximately three months of non-payment (see section 8). Domain registrations are annual and subject to the refund policy at /refunds.

4. Your content and your customers

You own the content of your sites. You grant us the licence needed to host, display, back up and deliver it. You are responsible for your content being lawful and for your relationship with your own customers — including honouring bookings, any payments you arrange with them, and your own refund promises. Payments between you and your customers (e.g. by Touch ’n Go, DuitNow, bank transfer or cash) happen directly between you; we do not collect, hold or process them and are not a party to those transactions.

5. AI features

AI-generated content (site copy, translations, suggested replies, tips) is produced by machine-learning models and may contain errors. Review AI output before publishing or sending it — especially suggested replies, which are never sent to your customers automatically. AI usage is metered per plan.

6. Acceptable use

You may not use the service for anything unlawful in Malaysia or your jurisdiction, including scams, phishing, counterfeit goods, malware, harassment, or content that infringes others’ rights; nor to send spam via our notification systems. We may suspend or remove sites that breach this section, with notice where practicable.

7. Availability

We aim for high availability but the service is provided “as is” without uptime guarantees. Published sites are served on Cloudflare’s global network. We take nightly backups of platform data for disaster recovery; you can export your own data (enquiries, bookings, submissions, payments, invoices) as CSV at any time.

8. Termination and data

You can delete your account at any time from the dashboard; published sites are taken down and your data is removed, except invoices and records we must keep for Malaysian tax law. If your subscription lapses, sites go offline after the grace period and remaining account data is deleted after approximately three months.

9. Liability

To the maximum extent permitted by law, our total liability for any claim relating to the service is limited to the fees you paid us in the three months before the claim arose. We are not liable for indirect losses, lost profits, or the acts of your customers or third-party providers.

10. Changes and law

We may update these terms; material changes will be notified by email or in the dashboard, and continued use is acceptance. These terms are governed by the laws of Malaysia, and disputes are subject to the courts of Malaysia.
